Astana Clarifies New Procedures for Executing Notarial Inscriptions
Astana unveils new notarial procedures effective Sept 8, 2026, enhancing debtor rights and automating processes.

On July 8, 2026, Kazakhstan adopted the Law of the Republic of Kazakhstan "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan Regarding Notarial Activities and Legal Assistance." This law introduced changes to the process of executing notarial inscriptions, notifying debtors, and the automatic distribution of applications among notaries. These changes were explained by Bakytzhan Beysen, Deputy Head of the Department of Justice of Astana, during a briefing at the Capital's Communication Service, reports ЖКХ24 citing the city administration's website.
The new requirements will take effect on September 8, 2026. Debtors will have the right to submit a reasoned objection to a notary, while notaries retain the authority to cancel a notarial inscription.
From the specified date, no notarial inscriptions will be executed for claims arising from public procurement contracts and procurements under the legislation on the procurement of certain quasi-public sector entities. Such claims will be handled through the judicial system. When exercising state control, territorial justice authorities are required to consider the legal basis for the debt's origin.
Starting January 1, 2027, applications from citizens and legal entities for executing notarial inscriptions will be distributed among notaries via the Unified Notarial Digital System. This aims to enhance the transparency of the distribution process and prevent abuses in choosing a notary. Until January 1, 2027, creditors can independently approach notaries.

Additionally, from September 8, 2026, notarial inscriptions will be executed based on the debtor's registration location, eliminating previously available alternatives. Requirements for the debtor's written acknowledgment of obligations have also been specified. It must confirm the existence of the debt, its amount, and the sum subject to collection.
A copy of the notarial inscription will be sent via the Unified Notarial Digital System with confirmation of delivery. After its execution, the debtor will be notified through the "e-Government" web portal and SMS. Debtors will be able to view the notarial inscription in their personal account via eGov Mobile.
Debtors have the right to submit a reasoned objection to a notary within 10 working days from the receipt of the notarial inscription copy. If the objection is submitted on time and contains reasons for disagreement, the notary must cancel the notarial inscription within three working days.
The changes also mandate the automation of sending notarial inscriptions for enforcement through digital systems. Overall, the changes are aimed at increasing the transparency of notarial procedures and protecting the rights of debtors.
